TERMS AND CONDITIONS

The following terms and conditions (‘booking conditions’) form the basis of your contract with Wings Luxe Travel (‘WLT’, ‘we’ or ‘our’). Please read them carefully as they set out your and our respective rights and obligations. These Terms & Conditions were correct at time of publication.

We reserve the right to change these Terms and Conditions (Booking Conditions) at any time prior to you making a booking request.

Please read these booking conditions carefully, as they apply to all bookings accepted by Wings Luxe Travel.

“You” and “Your” means all persons named in a booking (including anyone who is added or substituted at a later date). “We”, “us”, “our” and “Wings Luxe” means Wings Luxe Travel.

GENERAL CONDITIONS

By requesting us to confirm your booking, we assume you have read these booking conditions, agree to them, and agree that they apply to your holiday arrangements booked with us. References in these booking conditions to your  ‘journey’ refer to the tour package you have booked with WLT. References to ‘excursions’ or ‘experiences’ refer to short trips or tours included or available as part of your journey.

GOVERNING LAW

These booking conditions are governed by the law in force in Queensland, Australia.

Pricing Policy

The prices listed are accurate at the time of publication but are subject to change. Prices may be adjusted due to promotions, special offers, or changes post-publication for reasons including government tax adjustments, exchange rate fluctuations, fuel surcharges, airline charges, force majeure events, or supplier cost increases. For the latest prices, visit our website www.wingsluxetravel.com Prices will be confirmed at booking and remain valid for seven days. Once the non-refundable deposit is paid, the price is guaranteed. All bookings are subject to availability.

Deposit Requirements

A non-refundable deposit is required at booking:

  • Journey Fare under $10,000 per person: $1,500 per person
  • Journey Fare between $10,001 and $30,000 per person: $2,500 per person
  • Journey Fare over $30,001 per person: $5,000 per person

Final Payment

The remaining balance for your journey is due 120 days before the international journey start date.

Full payment is required at the time of booking if a booking reservation is made within 120 days from journey start date. Wings Luxe Travel reserves the right to cancel any booking if payment is not received within the specified timeframe. All charges are in Australian dollars (AUD) If a reservation cannot be confirmed, all payments will be refunded.

Airline Payments 

The deposits listed exclude any airline payments if Wings Luxe Travel is arranging flights with your booking. Your Guest Relations consultant will provide details on required payments and schedules for flights.

Journey Inclusions 

Your journey includes accommodation, gratuities, transfers, sightseeing, excursions, experiences, meals with select wine, beer, and soft drinks at lunch and dinner, admissions, port charges, taxes, and the services of a Journey Director as specified in your itinerary. Experiences are included unless otherwise stated but may have capacity limits.

Journey Exclusions

Journeys do not include airfares (unless stated), passport and visa fees, travel insurance, vaccinations, personal expenses (laundry, bar bills, phone calls), drinks outside of lunch and dinner, expenses for items purchased away from group tours, excess luggage charges, and any items not mentioned. 

Selecting Your Journey Departure

Journeys operate on specified dates. To ensure a Wings Luxe Travel journey meets your expectations, choose a date suited to your requirements. 

Gratuities

Gratuities for land portions, shore excursions, experiences and onboard river or sea cruises are included in the journey price and are not redeemable for cash.

Accommodations

In remote locations, hotel standards may be lower than in major centres Wings Luxe Travel aims to use the best available accommodation to ensure cleanliness, comfort, and service. Listed hotels are typically used, but substitutions of equivalent standard may be necessary. Check-in is usually after 3pm, and check-out is by 10am.

Room Types

Accommodation is in standard twin or double rooms unless otherwise specified.

Solo Travellers

A limited number of single rooms/suites/cabins may be available upon request. Single accommodations are often smaller and may only have one single bed.

Cabin/Suite Selection on Cruises

Wings Luxe Travel will try to accommodate specific cabin requests but reserves the right to make changes within the booked category without prior notice.

Special Assistance Needs

Passengers with disabilities or special needs should notify Wings Luxe Travel at the time of booking. Any changes in health, mobility, or fitness must also be reported prior to departure. Passengers requiring special assistance must travel with a companion who can provide necessary help. Wings Luxe Travel cannot provide personal assistance.

Health and Fitness

A good level of fitness and health is required. Extensive walking and stair climbing may be involved. Consult a doctor before travelling for any necessary vaccinations. Inform Wings Luxe Travel of any medical conditions that might affect your participation.  Wings Luxe Travel is not liable for any injury or illness that could have been prevented with prior disclosure.

Visa and Passports

Passengers must have a passport valid for at least six months after the return date with two unused, double sided pages 

Shore Excursions

Excursion timings may vary and are subject to change. Some city sightseeing may be walking tours. Passengers must be able to embark/disembark ships and negotiate steps.

Experiences

Some experiences have minimum and maximum group sizes. If your preferred option is unavailable, an alternative may be offered.

Transfers

Airport transfers are included at designated times. No refunds for unused transfers. Group transfers are shared and may depart at set times. Passengers missing pre-booked transfers must arrange their own transport at their expense.

Transfers are only for the first and last day of a journey.

Public Holidays & Festivals

Public holidays and festivals may disrupt your holiday and reduce available facilities and entertainment.

Special Offers

New special offers introduced after program release do not apply to existing bookings unless stated. 

Airfare Arrangements

All fares are the responsibility of each guest. If a guest requires assistance with flight recommendations that they can take to a travel agent will be at a cost of $250 (AUD) per person. Flight schedules are subject to change without prior notice. Once air tickets have arranged by Wings Luxe Travel on your behalf, airline amendments or cancellation fees apply and may be non-refundable. Fees will also apply for name changes and voluntary schedule alterations. Wings Luxe Travel is not responsible for any air travel delays or disruptions. Once tickets are issued, Wings Luxe Travel has no further liability and will not refund the cost of any services booked in conjunction with the flights.

Travel Insurance Requirement

Travel insurance is not included in your journey booking. For your protection, comprehensive travel insurance covering the full cost of your holiday, medical expenses, loss of luggage, land content, and airfare charges due to cancellation, disruption, or strikes is mandatory. If you travel without insurance, Wings Luxe Travel assumes no additional responsibility for any items or incidents that would normally be covered by travel insurance.

Travel Documentation and Information

After booking, you will receive an invoice with crucial details about your journey. We strongly recommend checking these details thoroughly. Verify flight times on your tickets, especially for early departures. Two weeks before departure, you will receive final itineraries, detailed travel information, and a list of passenger names and suburbs. If you do not wish to appear on the passenger list, inform your Wings Luxe Travel Guest Relations Consultant at the time of booking.

Special Requests

If any special request (e.g., dietary requirements, room location, bed type, specific hotel facilities, or particular meals) is essential for your journey, inform us when booking. Wings Luxe Travel will convey your request to the relevant suppliers, but cannot guarantee fulfilment. Confirmation of a special request does not form a contract term. All special requests are subject to availability until explicitly confirmed.

Credit and Debit Card Fees

Payments made by credit card to Wings Luxe Travel will incur surcharges. The surcharge varies from 1.15% to 1.7%, depending on the card used.

Information Accuracy

Wings Luxe Travel strives to ensure that all details regarding accommodation, itineraries, and prices are accurate at the time of publication. However, descriptions, facilities, and prices may change after publication. Confirm details at the time of booking. Final details will be on your itinerary. Journeys or excursion itineraries may also change due to local conditions, weather, or events. Wings Luxe Travel will notify you of significant changes before departure.

Events Beyond Control (Force Majeure)

Force Majeure refers to events beyond Wings Luxe Travel’s reasonable control that could not have been prevented. This includes war, natural disasters, industrial disputes, terrorist activities, significant changes in law, and other unforeseen events.

Modifications Due to Force Majeure

If Wings Luxe Travel determines that a Force Majeure event prevents the lawful or safe provision of services, it may, with immediate effect, terminate or change your travel arrangements to ensure safety, billing you for any additional costs.

Liability Limitation in Force Majeure Events

Wings Luxe Travel is not liable for any loss, damage, costs, or injuries resulting from cancellations or changes due to Force Majeure. No refunds will be given for deposits or purchase prices if travel arrangements are altered or canceled due to these events. Travel insurance must cover such risks as Wings Luxe Travel is not responsible for these unforeseeable events.

You acknowledge that these terms are necessary to protect Wings Luxe Travels legitimate interests, given the expected non-recoverable costs and efforts involved prior to the commencement of your journey or a Force Majeure event.

Modifications or Enhancements to Your Journey

Should you wish to alter any aspect of your journey plans after receiving your invoice, we will endeavour to accommodate your request, although it may not always be feasible. All modification requests must be submitted in writing by the individual who made the initial booking. If changes are possible, an administration fee and any additional costs incurred will apply.

Refund and Cancellation Policy

The following cancellation fees from Wings Luxe Travel apply, in addition to any charges from independent suppliers such as airlines and hotels:

International Journeys:

  • 120 days or more before departure: Loss of deposit
  • Less than 120 days before departure: Loss of 100% of the journey price

All cancellation notices must be submitted in writing to Wings Luxe Travel and are only effective once received. If your journey has already begun, no refunds will be issued for any unused services or missed portions of the journey.

Additional cancellation fees may apply for accommodation booked outside the journey dates. These fees are in addition to any charges imposed by Wings Luxe Travel and your travel agent (if applicable). You agree that the cancellation fees represent a fair estimate of Wings Luxe Travel’s loss and are necessary to protect their legitimate interests. If changes are requested after documents have been issued, Wings Luxe Travel may charge an administration fee of $90 per person, in addition to any applicable cancellation fees.

Adjustments to Your Journey

Wings Luxe Travel strives to deliver all the services confirmed at the time of your booking. However, because we arrange plans far in advance and rely on independent providers such as land operators and hotels, some changes might be necessary. Wings Luxe Travel reserves the right to modify or cancel journeys or excursions and experiences as needed.

Tour Viability and Group Atmosphere

All journeys require a minimum number of participants to be financially viable and to ensure a pleasant group experience. If the minimum number is not met, we may need to cancel the scheduled departure and offer the closest possible alternative date, or provide a refund for the arrangements made by Wings Luxe Travel.

Local Purchases
 

Wings Luxe Travel is not responsible for any items you buy locally, such as jewellery or furniture. You acknowledge that you are fully responsible for any import duties or shipping costs associated with these purchases.

Personal Items and Lost Property

For security purposes, valuable items should be minimised and kept in your carry-on luggage along with any medications. It is your duty to safeguard your belongings at all times and to ensure that you have comprehensive travel insurance to cover any potential losses.

Noise and Vibrations

Wings Luxe Travel makes reasonable efforts to minimise noise and vibrations on the cruise vessels that it uses. However, you acknowledge and accept that some noise and vibration are inevitable, and Wings Luxe Travel is not responsible for any discomfort caused by such occurrences.

Coach Tour Seat Assignments

To provide all passengers with the opportunity to enjoy forward and window seats, a daily seat rotation system may be implemented on longer journeys at the Journey Director’s discretion. We cannot guarantee adjustments to this system to suit personal preferences.

Changes to Cruising and Itinerary Plans

Itineraries serve as guides and may change without notice. Adjustments may be necessary due to various factors such as road, river, or weather conditions, strikes, airline schedule changes, or other reasons beyond Wings LuxeTravel’s control. If routes become unsafe for navigation, Wings Luxe Travel reserves the right to offer alternative services, including docked ship accommodation or substitute land arrangements.

Itinerary Modifications

While we strive to operate itineraries as published, sometimes changes are necessary due to circumstances beyond our control. Wings Luxe Travel is not liable for any direct or indirect costs incurred due to changes in your itinerary. Additionally, no refunds will be provided for alterations caused by flood, water level events, or other uncontrollable events.

Arrival and Departure Times

Wings Luxe Travel cannot guarantee precise arrival and departure times for carriers and operators used, and is not responsible for missed connections with any services or attractions beyond its control.

Privacy Policy

Wings Luxe Travel collects and retains personal information, including sensitive and health information, for business purposes. Our Privacy Policy explains the reasons for collecting this information, the potential recipients (including those overseas), and the implications if the information is not provided. It also includes details on how you can access or correct your personal information and outlines our complaint resolution process. You can view our Privacy Policy at www.wingsluxetravel.com/privacy-policy By providing your personal or sensitive information, you agree to the terms outlined in our Privacy Policy.

Photography and Videography

Photos or videos may be taken during the journey for inclusion in our social media posts, story’s and reels, for use in promotional material, on the internet, in print and on our website. If you prefer not to have your image/s used please inform your Guest Relations consultant before the journey begins or your Journey Director at the start of your journey. 

COVID-19 Travel Protocols

Before booking and travelling, please check the latest government travel regulations. Additionally, familiarise yourself with Wings Luxe Travel’s safety measures and guest obligations. These may include temperature checks, Rapid Antigen Testing, completing a health questionnaire, wearing masks, and isolating if COVID-19 symptoms appear during the journey. Compliance is mandatory, and refusal to comply may result in denied boarding.

Liability Disclaimer

  1. Our journeys include services from independent providers like hotels, airlines, cruise companies, and other operators who are not agents or employees of Wings Luxe Travel. While we carefully select these providers and their optional excursions and experiences, Wings Luxe Travel is not responsible for their conduct or the consequences of that conduct. Optional excursions may include activities such as climbing, exploring, biking, swimming, and snorkelling. You assume all risks associated with these activities.

  2. If a Wings Luxe Travel representative believes your mental or physical condition, or behaviour, affects your health and safety, makes you a hazard, or causes issues for other passengers or staff, you may be denied participation in all or part of the journey. Guests showing known COVID-19 symptoms may be asked to leave. Abuse or harassment of crew, suppliers, or other guests may also result in immediate removal. You are responsible for arranging and paying for your transport home if asked to leave, and no refunds will be provided for the unused portion of the holiday package.

  3. Wings Luxe Travel is not responsible for any death, injury, illness, loss (including loss of enjoyment), damage, detention, or delay beyond its control.

  4. Any terms, conditions, or warranties implied by statute or otherwise regarding the journey are excluded to the fullest extent permitted by law. Nothing in these terms restricts or modifies the application of the Competition and Consumer Act 2010 (Cth) as amended.

  5. To the extent permitted by law, Wings Luxe Travel’s liability is limited to re-supplying the services or paying the cost of re-supplying the services and excludes liability for any indirect or consequential losses, including economic loss or special, extraordinary, or punitive damages.

  6. Your travel agent will forward deposits and payments to us, but they are not our agent for receiving payments. Receipt of payments by the travel agent does not constitute receipt by us until Wings Luxe Travel confirms receipt. Wings Luxe Travel reserves the right to cancel bookings or refuse passengers if payment is not received within the specified time.

  7. Specific meal requests will be noted but cannot be guaranteed.

Smoking Policy

Smoking is prohibited on tourist coaches, but frequent stops are made for those who wish to smoke. Please ensure that you smoke far away from the group and any other people. Smoking is also not permitted in hotel rooms or ship cabins. Wings Luxe Travel books non-smoking rooms but cannot be guaranteed at all times.

Alcohol Service

Our staff are trained in the responsible service of alcohol and are legally required to refuse service to any guest whom they believe to appear intoxicated or behaves aggressively or offensively.

Service Issues

If you encounter a problem during your journey, please inform your Journey Director promptly so it can be addressed. 

Baggage Allowances

Luggage limits vary by journey and will be specified in your pre-departure documentation. Checked baggage dimensions are determined by adding the width, height, and depth of the luggage.
